Terms of Use

1. About Guitar Cap Alpha

Guitar Cap is an early-stage guitar-practice tracking service. It lets users record and organise guitar practice, save practice-related information and review progress over time. Core features can be used as a guest on the current browser/device. Approved Private Alpha accounts can sign in to back up and sync supported data. The Alpha is experimental and may evolve during testing.

2. Operator

3. Eligibility

You may use Guitar Cap if you can lawfully use the service and accept these Terms under the law that applies to you. Where applicable law requires a parent, guardian or other authorisation for a specific action, that requirement applies. Guitar Cap does not collect a date of birth simply to use the Alpha.

4. Accepting the Terms

By selecting the action that confirms acceptance, you agree to these Terms. The Privacy Policy explains how personal data are handled. Acknowledging the Privacy Policy is not the same as consenting to optional analytics; optional analytics require a separate choice.

5. Guest use

You do not need an account to try core guest functionality. Guest practice is stored on the current browser/device and is not a cloud backup. Guest data may be lost if browser/site data are cleared, storage is reset or the browser/device is no longer available.

6. Private Alpha accounts

Private Alpha account access is limited and may be reviewed manually. Requesting access does not guarantee approval. If approved, you can sign in to supported account and sync functionality.

You are responsible for keeping your login credentials confidential and for taking reasonable steps to protect your account. Do not share credentials in a way that compromises account security, bypass access status or security controls, or attempt to access another person's account or data.

7. Alpha pricing

Guest use and the Private Alpha are currently free. No payment card is required and requesting Alpha access does not create an automatic charge. If paid plans, subscriptions or trials are introduced, the relevant price and terms will be presented before a charge or paid commitment is created.

8. Your content and practice material

You retain ownership of content that you create and rights that you already hold. You grant Guitar Cap the limited rights needed to host, store, process, display, transmit and technically transform that content only as necessary to provide, secure and operate the service. Only upload, link or submit material that you are entitled to use.

9. Third-party material and services

Links, videos, tabs, scores, social posts and other third-party material remain subject to the rights, availability and terms of their respective owners/platforms. Guitar Cap does not grant rights to third-party content. If you choose to load or open third-party content, the third-party service may process data under its own terms and privacy practices.

10. Acceptable use

Do not use Guitar Cap to violate applicable law, infringe intellectual-property rights, distribute malware, interfere with or disrupt the service, probe or bypass security controls without authorisation, access another person's data, or upload unlawful or harmful content.

11. Feedback

If you voluntarily send feedback, suggestions or bug reports, Guitar Cap may use them to evaluate and improve the product without an obligation to compensate you. This does not transfer ownership of separate copyrighted content you provide merely as an example or attachment.

12. Service quality and consumer rights

Guitar Cap is an Alpha service, but applicable mandatory consumer rights remain unaffected. Where the law gives consumers rights relating to supply, conformity, remedies, updates or modifications of a digital service, nothing in these Terms is intended to exclude or limit those rights where they cannot lawfully be excluded or limited.

13. Changes to the Alpha

Because Guitar Cap is under active development, we may change features, interfaces, technical requirements, limits and supported workflows for valid reasons such as improving functionality or usability, addressing security or reliability, maintaining technical compatibility, responding to legal or regulatory requirements, adapting infrastructure, preventing abuse or changing the scope of the Alpha.

Changes will not create an additional charge unless a separate paid offer is clearly presented and accepted. Where applicable law requires notice or grants rights because a change materially and negatively affects access to or use of a digital service, those requirements and rights remain unaffected.

14. Availability

We aim to operate Guitar Cap with reasonable care, but the Alpha may experience interruptions, bugs or temporary unavailability. To the extent permitted by law, we do not promise uninterrupted or error-free availability. This does not exclude obligations or remedies that cannot lawfully be excluded.

15. Practice outcomes and professional advice

Guitar Cap is a practice organisation and tracking tool. It does not guarantee a specific learning, performance or improvement outcome. It is not a substitute for medical advice or other regulated professional advice.

16. Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law. Subject to mandatory rights, Guitar Cap is not intended to be responsible for losses that are indirect, unforeseeable or not reasonably connected with use of the Alpha.

17. Suspending or ending access

You may stop using Guitar Cap at any time. We may suspend or end account access where reasonably necessary for security, abuse prevention, breach of these Terms, legal compliance, material technical or operational reasons, or ending/restructuring the Private Alpha. Where applicable law requires notice or provides rights concerning termination or digital-service data, those rules remain unaffected.

18. Account deletion and data

You may request deletion of your account and applicable personal data by contacting hello@guitarcap.com. Deletion is handled according to the Privacy Policy, applicable legal obligations and the normal lifecycle of backups/security records. Removing browser/site data removes local guest data from that browser.

19. Privacy

Personal data and browser storage are described in the Privacy Policy and Cookie & Browser Storage Policy. Optional analytics are subject to a separate privacy choice.

20. Governing law

These Terms are governed by Italian law. If you are a consumer, this does not remove mandatory protections that apply under the law of your country of residence or mandatory rules on jurisdiction.

21. Changes to these Terms

We may update these Terms as Guitar Cap evolves. If a material change requires renewed acceptance or specific notice under applicable law, we will provide it before the updated Terms are applied as required.
